NOTICE OF TRUSTEE'S SALE NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 12, 2020, executed by Borrower(s), D`Annie Isra El, to Marc J. Slotnick, the Trustee of record in the office of the Clerk of the County Commission of Harrison County, West Virginia, in Book 1417, at Page 1071. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 912 Stutlers Fork Rd, Jane Lew, WV 26378. Pill & Pill, PLLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated May 9, 2023, of record in the Clerk's Office in Book 1496, Page 388. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Harrison County, in Clarksburg, West Virginia, on the following date: September 13, 2023 at 2:51 p.m. All the following described parcels of real estate situate on the right hand fork of Kincheloe Creek, Union District, Harrison County, West Virginia, and more particularly described as follows: Tract One: Beginning at a sugar maple, a corner to land owned by John W. Cook and Beverly Barnes; thence N. 39 07` E. 1721.03 feet to a black oak, corner to land of Everett M. and Anna Myer; thence S. 10 00` W. 684.75 feet to a chestnut, corner to land of Ed R. and Edith W. Wendell, III; thence S. 21 30` E. 247.50 feet to a white oak; thence with said Wendell line, S. 35 30` W. 500 feet to an iron pin in line of land owned by said John W. Cook and Beverly Barnes; thence with said line S. 88 15` W. 767.80 feet to the place of beginning, containing 13.34 acres, more or less. Tract Two: Beginning with a white oak on the ridge, thence S. 35 30` W. 407.50 feet to a red oak; thence S. 5 30` E. 255.75 feet to a red oak; thence S. 20 00` E. 561.00 feet to a gum; thence N. 88 30` W. 580.00 feet to a stake and markers in the county road; thence with the center of said county road N. 16 00` W. 92.55 feet; thence N. 13 45` W. 442.00 feet; thence N. 34 30` W. 274.00 feet to a stake and markers; thence leaving the county road N. 59 00` E. 116.85 feet; thence N. 82 30` E. 174.90 feet; thence N. 52 00` E. 321.50 feet to a sugar maple; thence N. 88 15` E. 767.80 feet to the initial point, containing 20 acres more or less. Being the same tract or parcel of land conveyed unto D`Annie Isra El from Carroll G. Dean, Jr. and Carolyn Sue Dean, by deed to be recorded in the Office of the Clerk of the County Commission of Harrison County, West Virginia, in Book 1674, at Page 17. TERMS OF SALE: 1) The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
